Overview

Faith Culture is a Christian lifestyle brand operated by Petrah Holdings International Ltd. The terms “Faith Culture,” “we,” “us” and “our” refer to Faith Culture and Petrah Holdings International Ltd, as applicable.

We operate FaithCulture.ca and provide related website content, features, products, services and tools, collectively referred to as the “Services.” Our online store is powered by Shopify.

These Terms of Service, together with the policies referenced in them, explain the terms that apply when you visit, browse, purchase from or otherwise use our Services.

By using the Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

You must be at least the age of majority in your province, state or place of residence, or have any permission required by applicable law, to use the Services.

When you provide information to us, including your name, email address, billing information, payment information or shipping address, you agree that the information is accurate, current and complete.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

2. Products and Product Information

We make reasonable efforts to describe and display our products accurately.

Product colours and appearance may vary depending on your screen, device and display settings.

Product descriptions, materials, specifications, availability and prices may change without notice. We may discontinue products or limit quantities where reasonably necessary.

Because some Faith Culture products are made to order, minor variations may occur between individual items.

3. Orders

When you submit an order, you are making an offer to purchase the products in that order.

An order is accepted when we confirm the order and successfully process the applicable payment.

We may refuse, cancel or modify an order where permitted by law, including because of:

  • Payment problems

  • Suspected fraud

  • Pricing or product information errors

  • Product availability issues

  • Shipping restrictions

  • Other legitimate operational reasons

If we cancel an order after payment has been processed, we will issue any refund required.

Please review your order carefully before submitting it. Changes or cancellations may no longer be possible once production or fulfillment has started.

Returns and refunds are governed by our Refund Policy.

4. Prices, Payments and Promotions

Prices, discounts and promotions may change without notice.

The price charged for an order is the price displayed at checkout when the order is submitted, subject to the correction of obvious errors where permitted by law.

Applicable taxes, shipping charges and other fees will be shown or calculated at checkout where possible.

Prices displayed through third-party marketplaces or sales channels may differ from prices available directly through FaithCulture.ca.

You agree to provide accurate and complete billing and payment information and confirm that you are authorized to use the payment method submitted with your order.

Promotional offers may have separate eligibility requirements, expiration dates, exclusions or other terms. Where specific promotional terms apply, those terms govern that promotion.

5. Shipping and Delivery

Shipping destinations, processing times, delivery estimates, tracking and related information are described in our Shipping Policy.

Made-to-order products generally require additional processing time before dispatch.

Delivery dates are estimates and are not guaranteed.

Delivery can be affected by circumstances outside our reasonable control, including carrier delays, weather, customs processing, service interruptions and peak shipping periods.

Nothing in this section limits rights or protections that cannot be excluded under applicable consumer protection law.

6. Returns and Refunds

Returns, exchanges and refunds are governed by our Refund Policy.

Nothing in these Terms limits any mandatory return, refund or consumer protection rights that apply to you under applicable law.

7. Intellectual Property

Unless otherwise stated, the Faith Culture name, branding, website content, product designs, photographs, videos, text, graphics and other materials made available through the Services are owned by or licensed to Faith Culture or Petrah Holdings International Ltd and are protected by applicable intellectual property laws.

The Services are provided for your personal, non-commercial use.

You may not reproduce, distribute, modify, republish, sell, commercially exploit or create derivative works from protected Faith Culture materials without our prior permission, except where permitted by law.

“Faith Culture” and associated branding, names and designs may be trademarks or other protected intellectual property of Faith Culture or Petrah Holdings International Ltd.

Shopify's names, trademarks and branding belong to Shopify or its affiliates.

All other third-party names and trademarks remain the property of their respective owners.

8. Optional Tools and Third-Party Services

We may provide access to tools, applications, payment providers or other services operated by third parties.

We do not control all third-party tools or services and cannot guarantee their availability, accuracy or performance.

Your use of third-party services may also be governed by the terms and privacy policies of those third parties.

To the extent permitted by applicable law, Faith Culture is not responsible for losses caused solely by third-party services that we do not control.

9. Third-Party Links

The Services may contain links to websites or resources operated by third parties.

A link does not necessarily mean that we endorse or control the third-party website or its content.

If you choose to visit or purchase from a third-party website, you should review that party's terms, policies and practices.

Questions or disputes relating specifically to third-party products or services should be directed to the relevant third party.

10. Relationship With Shopify

FaithCulture.ca is powered by Shopify, which provides the ecommerce technology used to operate portions of our Services.

Products purchased from Faith Culture are sold by Faith Culture, not by Shopify.

Shopify is not the seller of Faith Culture products and does not control our product descriptions, pricing, fulfillment decisions, return decisions or customer service.

Shopify may process information as necessary to provide its ecommerce platform and related services.

11. Privacy

Our collection, use and disclosure of personal information are described in our Privacy Policy.

Because our store is powered by Shopify, Shopify may also collect and process personal information in connection with its ecommerce platform.

Your privacy rights may vary depending on where you live.

12. Reviews, Comments and Feedback

If you voluntarily submit a review, comment, suggestion, idea, photograph or other feedback to Faith Culture, you confirm that you have the right to submit it and that it does not violate applicable law or another person's rights.

To the extent permitted by law, you grant Faith Culture a non-exclusive, worldwide, royalty-free licence to use, reproduce and display that feedback for purposes including operating, improving and promoting our business and Services.

We may remove feedback that we reasonably believe is unlawful, fraudulent, abusive, misleading, defamatory, obscene or infringing.

You remain responsible for the accuracy and legality of content you submit.

13. Errors, Inaccuracies and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to matters such as:

  • Product descriptions

  • Prices

  • Promotions

  • Shipping charges

  • Delivery estimates

  • Product availability

We may correct errors and update information where permitted by applicable law.

If a material error affects an order you have already placed, we will take appropriate steps, which may include contacting you, correcting the order or issuing a refund where required.

16. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, secure or available.

We do not exclude or limit any warranty, condition, guarantee or statutory right that cannot legally be excluded.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Faith Culture, Petrah Holdings International Ltd, and their directors, officers, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential losses arising from use of the Services or products purchased through them.

Where liability cannot legally be excluded, our liability is limited only to the extent permitted by applicable law.

Nothing in these Terms excludes liability that cannot legally be excluded or limits mandatory rights available to consumers under applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Faith Culture and Petrah Holdings International Ltd from third-party claims arising directly from:

  • Your unlawful use of the Services

  • Your material breach of these Terms

  • Your violation of another person's legal rights

This section does not require you to indemnify us for losses caused by our own unlawful conduct.

19. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be limited or severed to the minimum extent necessary.

The remaining provisions will continue in effect.

20. Waiver and Entire Agreement

If we do not immediately enforce a provision of these Terms, that does not mean we waive our right to enforce it later.

These Terms and the policies referenced in them form the agreement between you and Faith Culture concerning your use of the Services, subject to any additional terms that apply to a particular product, service or promotion.

21. Assignment

You may not transfer your rights or obligations under these Terms without our prior written consent where such consent is legally required.

We may transfer our rights or obligations in connection with a legitimate business transaction, restructuring or transfer of the business, subject to applicable law.

These Terms are governed by the laws applicable in Ontario, Canada, including applicable federal laws of Canada.

Nothing in this section prevents you from relying on mandatory consumer protection rights that apply in your province, state or country of residence.

Any dispute will be handled in accordance with applicable law and any jurisdictional rights that cannot legally be waived.

Section headings are provided for convenience only and do not affect the interpretation of these Terms.

24. Changes to These Terms

We may update these Terms from time to time for operational, legal, regulatory or business reasons.

The current version will be posted on this page with its updated date.

Where required by law, we will provide notice of material changes.

Your continued use of the Services after an updated version takes effect constitutes acceptance of the updated Terms, except where applicable law requires a different form of consent.
